TERMS OF USE — JIOGAMES

General

This document is an electronic record in terms of the Information Technology Act, 2000 ("IT Act") and the rules made thereunder, and is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, as amended from time to time ("IT Rules"), which mandates the publishing of rules and regulations, privacy policy and terms of use for access or usage of the Website and the Application. This electronic record is generated by a computer system and does not require any physical or digital signatures.

These Terms and Conditions / Terms of Service ("Terms" / "TOS") are further published in compliance with the Promotion and Regulation of Online Gaming Act, 2025 ("Online Gaming Act") and the Promotion and Regulation of Online Gaming Rules, 2026 ("Online Gaming Rules") framed thereunder.

These Terms, read with the Privacy Policy, disclaimers, and rules of JioGames as may be posted on the website having domain name www.jiogames.com ("Website") and the JioGames mobile application platform ("Application" or "App"), from time to time, shall govern your use and access of the Website, the Application, their related content, sites and hyperlinks owned, maintained and operated by Jio Platforms Limited ("JPL") and/or its Affiliates. The Website and the Application are hereinafter collectively referred to as the "Platform". These Terms apply to all Users of the Platform. Your access to or use of the Platform shall be, as a User, non-exclusive, non-transferable, revocable and subject to these TOS read with Privacy Policy.

By accessing or using the Platform, you accept these Terms, Privacy Policy, you also accept and agree to be bound by the rules, policies and other terms of JioGames as posted on the Platform from time to time and corresponding hyperlinks, if any. If you do not agree to be bound by these Terms, please do not access the Platform or avail any Services provided through the Platform.

Changes to the Terms

We may change, modify, amend or update these Terms from time to time by publishing an updated version on the Platform. By continuing to use the Platform, you will be deemed to accept the updated Terms and agree to be bound by them. It shall be your responsibility to verify these Terms each time you access the Platform.

Definitions

For the purpose of these Terms:

"Affiliate(s)" shall mean, with respect to JPL, any person directly or indirectly controlling, controlled by, or under direct or indirect common control with JPL, including its subsidiaries and associate companies.

"Agreement" means these Terms, as detailed herein, including all schedules, appendices, annexures, privacy policy, disclaimers, and will include references to this Agreement as amended, novated, supplemented, varied or replaced from time to time.

"Application" or "App" means the JioGames mobile software application that JPL has permitted you to download, access and use, and to which these Terms are linked.

"Authority" means the Online Gaming Authority of India established under sub-section (1) of Section 8 of the Online Gaming Act, or such other authority or agency as may be constituted or designated by the Central Government under the Online Gaming Act.

"Content" shall mean and include all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, game assets, game data, in-game items, virtual currency, and all other digital content collectively, whether generated by JioGames or by third-party developers or publishers.

"Customer(s)" or "User(s)" means any person who accesses, downloads, installs or uses the Platform or any Services offered through the Platform, including any person who plays or engages with any Game available through the Platform.

"Device" means any mobile device, tablet, personal computer, smart television, gaming console, set-top box, or any other electronic device on which JPL permits the downloading and use of the Application or the access and use of the Website for providing the Services.

"Digital Media Ethics Code" / "IT Rules" means the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, as amended from time to time, including any successor legislation or rules.

"Game(s)" means any online social game (as defined under the Online Gaming Act) or any other legally permissible and non-real money interactive digital entertainment content made available through the Platform by third-party game developers or publishers, which may be accessed, played or downloaded by Users.

"Game Developer(s)" or "Game Publisher(s)" means independent third-party entities that develop, publish, own and make available Games through the Platform.

"JPL" / "JioGames" / "we" / "us" / "our" shall mean Jio Platforms Limited (CIN U72900GJ2019PLC110816), with its registered office at Office - 101, Saffron, Nr. Centre Point, Panchwati 5 Rasta, Ambawadi, Ahmedabad 380006, Gujarat, India, and/or its Affiliates, service providers, successors and assigns, wherever the context applies.

"MSISDN" means the Mobile Subscriber Integrated Services Digital Network Number.

"Online Gaming Act" means the Promotion and Regulation of Online Gaming Act, 2025, as amended from time to time.

"Online Gaming Rules" means the Promotion and Regulation of Online Gaming Rules, 2026, framed under the Online Gaming Act, as amended from time to time, and includes any directions, orders, guidelines, or codes of practice issued pursuant to the Online Gaming Rules and the Online Gaming Act.

"Platform" shall have the meaning ascribed to it in the recitals.

"Privacy Policy" shall mean the Privacy Policy of JioGames in connection with the use of the Platform, as may be amended from time to time.

"Service(s)" means all services provided through the Platform, including but not limited to the streaming and facilitation of access to Games, subscriptions, in-game purchases, game-related community features, customer support, account management and any other services that may be included from time to time.

"Virtual Items" means any virtual currency, virtual goods, in-game items, power-ups, credits, tokens or other digital items that may be won, earned or otherwise obtained in relation to one or more Games or through user engagement through the Platform. For the avoidance of doubt, Virtual Items, are for consumption and enjoyment in Game play, and cannot be transferred, conveyed, sold, or otherwise monetised, and have no value as money or money's worth (including as deposits, stakes, winnings), or any form of consideration under applicable law.

"Website" means the website operated by JPL at the domain www.jiogames.com, which provides information related to the Services and enables Users to access and avail the Games and other Services.

"You" / "Your" shall mean the end user accessing the Platform, its contents and/or using the Services offered through the Platform.

Nature and Role of JioGames

JioGames is a technology service provider that operates the Platform as an online intermediary within the meaning of Section 2(1)(w) of the IT Act, and in accordance with the IT Rules, the Online Gaming Act and the Online Gaming Rules. JioGames provides a technology platform through which independent third-party Game Developers or Game Distributors ("Developers") make available the Games to the Users.

JioGames is not the publisher, developer, distributor, creator or manager of the Games made available through the Platform. The Games owned by the respective Game Developers or Game Publishers, who are solely responsible for the content, functionality, performance and legality of their Games. JioGames merely provides the technological infrastructure and platform services which enable Developers to make available Games, and Users to discover, access and interact with such Games.

In its capacity as an intermediary and technology service provider, JioGames does not exercise editorial control over the Games or their content, does not initiate or modify the transmission of Games or interactions between Users, Games, or Game Developers or Game Publishers, and does not select the recipients of such transmissions. JioGames' role is limited to providing access to the Platform and facilitating the technological means by which Users can interact with Games hosted thereon.

The User acknowledges and agrees that JioGames shall not be liable for any content, gameplay, outcomes, representations, warranties, or obligations arising from or in connection with any Game. All claims, disputes and grievances relating to the content, functionality, fairness, compliance or legality of any Game shall be directed to the respective Game Developer or Game Publisher, subject to the grievance redressal mechanism set out herein.

JioGames operates in compliance with the due diligence requirements prescribed for intermediaries under the IT Rules.

For the avoidance of doubt:

JioGames operates strictly as a cloud-based technology platform and hosting service;
Any obligations relating to:

classification or categorisation of Games;
determination by and/or registration with the Online Gaming Authority of India or any other regulatory authority to the extent applicable;
compliance with gameplay mechanics, rules of play, algorithms, randomisation processes, scoring systems, outcome determination, prize structures/distribution or monetisation; and
compliance of the underlying Game with applicable laws,

lie with the relevant Game Developer or Game Publisher.

JioGames does not, accordingly, act as an "online game service provider" under the Online Gaming Act.

Registration and Activation

In order to access the Services, you will be required to register on the Platform by creating an account. Registration may involve, without limitation, setting up a profile, providing your MSISDN, followed by a one-time password, username and password, your name, date of birth and other personally identifiable information as may be required.

For the Application, you will be required to download and install the App on your Device and authenticate access through such authentication mechanism as may be prescribed. At the time of installation of the Application, the Application will require your permission to enable it to access certain features of your Device, including but not limited to location, storage, camera, microphone, and network information. You acknowledge and agree that such permissions are necessary for the provision of the Services, and that your grant of such permissions constitutes your informed consent. Withdrawal/non-provision of any such permission may result in the unavailability or degradation of certain Services, and JPL shall have no liability to you in such event.

You represent and warrant that all information provided by you during registration and at any time thereafter is true, complete, accurate and up-to-date, and you agree not to submit any particulars which are false, misleading or incomplete, or any information you do not have any right or authority to provide. You are solely responsible for maintaining the confidentiality and security of your user account. You acknowledge and agree that JPL shall be entitled to rely upon any activity occurring under your account as having been duly authorised by you, and all activities that occur on or through your account shall be deemed to have been undertaken by you.

In order to use and/or register with the Platform, you must be 18 (eighteen) years of age or older, or such other minimum age as may be prescribed under applicable law. If any Game on the Platform specifies a higher minimum age for access, you must comply with such requirement.

By registering on the Platform, you hereby grant consent to receive communications from us, our Affiliates or authorised third parties via telephone, SMS, email, push notification, in-app notification or other electronic means, based on the information furnished by you. You acknowledge that you may opt out of promotional communications at any time through the settings available on the Platform or by following the unsubscribe instructions in such communications; provided, however, that you may not opt out of mandatory service-related, transactional or compliance communications, which shall continue to be sent to you for so long as you maintain an account on the Platform.

To use the Services, you will need a Device that meets the system and compatibility requirements for the relevant Services, which may change from time to time, working internet access, and compatible software. The performance, quality and availability of the Services may be affected by these factors, and JPL shall not be liable for any failure, degradation, interruption or delay in the delivery of the Services attributable to your Device, internet connectivity, software configuration or failure to meet the applicable system requirements. Such system requirements shall be your sole responsibility, and you acknowledge that JPL makes no representation or warranty regarding the compatibility of the Platform with any particular Device, operating system or network configuration.

Services and Games

The Platform allows Game Developers and Game Distributors to make available, and Users to access Games developed by independent third-party Game Developers or Game Publishers, including through game streaming, game downloads and cloud gaming. Users may access various features in Games including multiplayer gaming, in-game purchases and community features.

In relation to cloud-based or streamed access to Games, JioGames provides only the computational infrastructure, hosting environment and delivery mechanisms through which game instances are accessed by Users. JioGames does not operate the underlying game software, control its execution logic, or determine gameplay outcomes. Further, any tournaments, competitions or esports activities (if any) accessible through the Platform are either organised by third-party Game Developers or Game Publishers. JioGames does not control gameplay mechanics, determine outcomes, or operate (or provide access to) the Games.

The availability of any particular Game through the Platform is subject to the Game being made available by the Game Developer or Game Publisher under arrangements with JPL, and the catalogue of Games available through the Platform may be modified at any time without prior notice.

Such inclusion, removal or modification may be for the purposes of moderation, and compliance with law, and on the basis of directions from the Authority, including as issued through general or specific directions or codes of practice, to intermediaries, Game Developers or Game Publishers.

Certain Games may be subject to additional terms and conditions imposed by the Game Developer or Game Publisher. By accessing or playing such Games, you agree to comply with such additional terms. In the event of any conflict between these Terms and the additional terms of a Game, these Terms shall prevail to the extent of the inconsistency, unless the additional terms expressly state otherwise with our prior written approval.

Virtual Items and In-Game Purchases

One or more Games may permit you to earn, win, or otherwise obtain Virtual Items for use within Games. Virtual Items have no real-world monetary value and cannot be exchanged, refunded, conveyed, sold, transferred or otherwise monetized for real-world money, goods or services, except as expressly permitted under applicable law. Users shall not sell, trade, transfer, assign, gift or otherwise deal in Virtual Items (or accounts containing Virtual Items) whether inside, or outside the Platform, including through any secondary market, third-party website, auction site or peer-to-peer exchange. Any attempt to do so shall be void and may result in immediate termination of the User's account.

All purchases of Virtual Items are subject to the terms of the Games or Game Developers, and are typically final and non-refundable, except as required by applicable law. JPL reserves the right to manage, regulate, modify, or eliminate Virtual Items at any time, with or without notice, and shall have no liability to you or any third party in the event that it exercises such rights.

You acknowledge that you do not acquire any ownership interest in Virtual Items and that your license to use Virtual Items is limited, personal, non-transferable, non-sublicensable and revocable.

Engagement Rewards

In order to reward your commitment and engagement with the Platform, which will be independent of your engagement with Game(s), we may also offer engagement rewards at the sole discretion of the Platform and subject to applicable terms, policies and eligibility criteria. The engagement rewards do not result from any gameplay outcomes, buying in or participating in any Games. These engagement rewards may be exchangeable or redeemable for certain real-world goods or services made available from time to time. Such engagement rewards do not constitute legal tender, stored value or any form of currency, and shall not be transferable, assignable or redeemable for cash. The Platform reserves the right to modify, suspend or discontinue any exchange or redemption mechanism, including the valuation and availability of such engagement rewards, at any time without liability.

Price and Payment Policy

Your access to some features of Games may be offered on a chargeable basis by the relevant Developer and require payments of subscription fees, or one-time purchase fees. JPL may enable multiple payment options online for availing such paid features. However, JPL reserves it's right to add or delete any mode of payment without prior notice.

The online payment modes may include credit cards, debit cards, net banking, UPI, digital wallets, and such other modes as may be made available from time to time. We accept payments made by most major credit/debit cards issued in India. Acceptance of card payment is at the sole discretion of JPL. JPL reserves it's right to deny acceptance of card payment without prior notice.

While availing any of the payment methods available on the Platform, we will not be responsible or assume any liability whatsoever in respect of any loss or damage arising directly or indirectly to you due to:

(a) lack of authorisation for any transaction;
(b) exceeding the preset limit mutually agreed by you and your issuing bank;
(c) any payment issues arising out of the transaction;
(d) decline of transaction for any other reason;
(e) any error, delay or failure in the processing of any payment by any third-party payment gateway, bank or financial institution; or
(f) any unauthorised access to or breach of any payment system or mechanism not directly within JPL's control.

You acknowledge and accept that all payment transactions are processed through third-party payment service providers and that JPL acts solely as a facilitator in this regard and assumes no responsibility for the acts, omissions or defaults of such third-party providers.

JPL will not be liable for any credit/debit card fraud or any unauthorised use of your payment credentials. The liability for use of a card or any payment instrument fraudulently will be on you and the onus to prove otherwise shall be exclusively on you.

All payments made against the purchases of Services on the Platform by you shall be in Indian Rupees only. The Platform will not facilitate transactions with respect to any other form of currency.

JPL reserves the right to reflect any change in the price of any Services or subscription plans available through the Platform at any time, to enable compliance by Developers with all applicable laws, including the Online Gaming Act and the Online Gaming Rules.

Compliance with Online Gaming Legislation

Games must be operated in compliance with the Online Gaming Act and the Online Gaming Rules. Users acknowledge and agree that their use of the Platform is subject to such legislation and any regulations, directions, orders, guidelines or codes of practice issued thereunder.

Without prejudice to the generality of the foregoing, Users agree to comply with all applicable provisions of the Online Gaming Act and the Online Gaming Rules, including but not limited to any requirements relating to:

(a) age verification and eligibility for participation in Games;
(b) responsible gaming practices;
(c) prohibition on certain categories of games or activities as may be prescribed; and
(d) restrictions on deposits, wagers or stakes where applicable.

JPL reserves the right to restrict, suspend or terminate access to any Game or Service where such action is required by any order, direction or notification issued by the Authority, under the Online Gaming Act, the Online Gaming Rules, or by any other competent regulatory authority.

Compliance with the Digital Media Ethics Code

The Platform operates in compliance with the Digital Media Ethics Code. JioGames adheres to the due diligence requirements, content classification norms, and user safety standards prescribed under the Digital Media Ethics Code, including those applicable to online gaming intermediaries.

Users acknowledge that JioGames may, in compliance with the Digital Media Ethics Code, implement content rating mechanisms, age-gating, content moderation, and such other measures as may be prescribed to ensure that Content and Games available through the Platform are appropriately classified and that Users are protected from harmful or inappropriate content.

No Unlawful, Infringing or Offensive Activity

Your use of the Platform is subject to compliance with all applicable laws, including but not limited to the IT Act, the IT Rules, the Online Gaming Act, the Online Gaming Rules, and all other applicable central and state legislation.

You must not post, transmit or enable another person to post or transmit via the Platform any information or material or otherwise use the Platform for any activity which breaches any laws or regulations, infringes a third party's rights or privacy, or is contrary to any applicable laws.

Without limiting the foregoing, you shall not:

(a) use the Platform for any unlawful purpose, including but not limited to cheating, fraud, money laundering, or any form of illegal gambling;
(b) use any automated software, bots, hacks, mods or any unauthorised third-party software designed to modify or interfere with the Platform or any Game;
(c) exploit any Game or the Platform for any commercial purpose not authorised by JPL;
(d) engage in any activity that constitutes match-fixing, collusion, or any other form of manipulation of game outcomes;
(e) impersonate any person or entity or misrepresent your affiliation with any person or entity;
(f) use the Platform to distribute harmful, obscene, defamatory, inflammatory, threatening or otherwise objectionable content;
(g) reverse engineer, decompile, disassemble, decrypt or otherwise attempt to derive the source code, underlying algorithms or structure of the Platform or any Game;
(h) circumvent, disable or otherwise interfere with any security-related features of the Platform, including features that prevent or restrict use, copying or access;
(i) use another User's account without authorization or purchase any accounts from any person;
(j) scrape, harvest, crawl or use any automated means to collect data, content or information from the Platform;
(k) interfere with or disrupt the integrity, performance or availability of the Platform, any Game, or any servers or networks connected thereto; or
(l) engage in any other conduct that JPL determines to be harmful to the Platform, its Users, Developers, or JPL.

No Viruses or Other Interference

You must not transmit or enable another person to transmit via the Platform any virus, worm, trojan, logic bomb, keystroke logger, rootkit or other malicious code or other information or material, or otherwise use the Platform in a way which:

(a) tampers with, hinders the operation of or makes unauthorised modifications to the Platform or any Game;
(b) inhibits any other User from using the Platform;
(c) defames, harasses, threatens, menaces or offends any person;
(d) contains obscene, indecent, inflammatory or pornographic material or material that could give rise to civil or criminal proceedings; or
(e) imposes an unreasonable or disproportionately large load on the Platform's infrastructure.

Termination or Suspension of Access

We may suspend or terminate your account or access to all or any part of the Platform (including any Game) at any time, with immediate effect and without prior notice or liability, including if:

(a) you breach these Terms in our reasonable opinion;
(b) you violate any provision of the Online Gaming Act, the Online Gaming Rules, the IT Act, the IT Rules, or any other applicable law;
(c) you engage in any fraudulent, abusive, harmful, or suspicious activity on or through the Platform;
(d) we are required to do so by any regulatory authority, law enforcement agency, court order or direction under applicable law;
(e) we determine, in our discretion, that your continued access poses a risk to the Platform, other Users, or JPL's or its Affiliates' interests; or
(f) for any other reason as we may deem fit.

Upon termination or suspension:

(i) your right to access the Platform or Games, and use the Services shall cease immediately;
(ii) any Virtual Items, in-game progress, data or content associated with Games you access through your account may be forfeited;
(iii) JPL shall have no obligation to refund any amounts paid by you in connection with the Services; and
(iv) any licences granted to you under these Terms shall automatically and immediately terminate.

The provisions of these Terms include provisions relating to indemnity, limitation of liability, intellectual property, disclaimers, governing law and dispute resolution shall survive any termination or expiry of these Terms or your use of the Platform.

Content and Feedback

We may allow you to post, upload or otherwise make available content, feedback, reviews or other material via the Platform ("Your Content"), for which you should be registered with the Platform. You confirm that the particulars posted by you:

(a) are true and correct and shall not belong to any third party or be posted under fictitious names; and
(b) are not defamatory, obscene, infringing, harmful or otherwise unlawful or against public policy.

JioGames does not endorse, verify or assume responsibility for Your Content and acts solely as an intermediary in respect of such content.

For Your Content, you hereby grant us a non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable licence to use, reproduce, modify, adapt, publish or communicate to the public Your Content for the purposes of our business, and the right to sub-licence those rights to others or our Affiliates. You also consent to any act or omission that would otherwise infringe any of your rights (including moral rights) in Your Content.

You warrant that you have the right to grant the above license and that our exercise of the license rights above will not infringe the intellectual property rights of any third party, and that the content is neither defamatory nor in breach of any law. We may monitor or review Your Content but are not obliged to do so. We may also alter or remove any of Your Content at any time and without prior notice, including for operational integrity of our Services.

Intellectual Property

All intellectual property rights in the Platform (excluding the Games available through the Platform), including its design, text, graphics, applications, software, underlying source code and all other aspects, belong to us and/or our Affiliates.

Copyright: All Content included on the Platform (excluding the Games available through the Platform), such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of JPL, its Affiliates or its content suppliers and is protected by the appropriate intellectual property laws.

Trademarks: The trademarks "Jio", "JioGames", their logos, and other service marks and logos are owned by and/or licensed to JPL and/or its Affiliates. There will be certain trademarks of third parties, including Game Developers or Game Publishers, whose Games are made available through the Platform. These marks are used for representation purposes only and JPL does not claim any rights over these trademarks.

Intellectual Property Claims: JPL, its Affiliates and its content suppliers respect the intellectual property of others. If you believe that your intellectual property rights have been used in a way that gives rise to concerns of infringement, please write to us with your concerns and we will try to address them.

No part of the Platform, including audio and video excerpts, game assets, or any other Content, may be reproduced, adapted, modified or transmitted in any form or by any means, electronic, mechanical, photocopying, recording or otherwise, without our prior written permission.

Links

The Platform may provide links to various websites, applications and services for your convenience only, and we have no control over the linked websites and/or applications. We do not maintain, sponsor, endorse or recommend any third-party websites or applications, and shall not be responsible or liable for their content, policies, practices, or any infringement of intellectual property rights or any information or opinions on such third-party platforms. Your use of those linked sites, mobile software applications and services is subject to the terms of use and privacy policies of each such website and service, in addition to this Agreement and the Privacy Policy.

Information Security

We are committed to safeguarding the security and confidentiality of any information you provide to us. We understand that you accept the inherent security implications of providing information over the internet and will not hold us responsible for any breach of security or disclosure of personal information. If you become aware of any violation of the security of data or the Agreement, please contact us immediately.

Notwithstanding the foregoing, the Customer's personally identifiable information will be used only in accordance with the Privacy Policy and to the extent permitted under applicable laws, including the IT Act, the IT Rules, the Online Gaming Act and the Online Gaming Rules.

Data may be shared with Developers in accordance with the Privacy Policy and applicable law.

Responsible Gaming

JioGames is committed to promoting responsible gaming practices in compliance with the Online Gaming Act and the Online Gaming Rules. Users are encouraged to:

(a) set appropriate time and spending limits on their gaming activity;
(b) avoid gaming activity that may interfere with personal, family, or professional obligations;
(c) seek assistance if they believe their gaming behaviour is becoming problematic; and
(d) utilise any self-exclusion or cooling-off tools made available on the Platform.

JioGames may, in compliance with the Online Gaming Rules and the IT Rules, implement safeguards including but not limited to, session time reminders, deposit limits, self-exclusion mechanisms, and awareness information regarding responsible gaming. Users agree to comply with any responsible gaming measures implemented on the Platform.

Indemnity

You agree to indemnify us, our Affiliates, Game Developers, Game Publishers and other persons involved in the creation and operation of the Platform for all damages, losses and costs (including legal costs) which arise out of or relate to your use of the Platform or any acts committed by you in violation of applicable laws and this Agreement. This indemnification includes, without limitation, liability relating to copyright infringement, defamation, invasion of privacy, trademark infringement, violation of the Online Gaming Act or the Online Gaming Rules, and any breach of this Agreement.

Limitation of Liability

In no event shall JPL, including its Affiliates and their respective owners, directors, officers, employees, agents, shareholders, partners, successors and assigns, be liable for any loss or damage whatsoever, including without limitation direct, indirect, punitive, incidental, special, exemplary and consequential damages, lost profits, loss of data, loss of goodwill, business interruption, or damages resulting from the use or inability to use the Platform or any Game, whether based on warranty, contract, tort (including negligence), strict liability, statute or any other legal theory.

Without limiting the generality of the foregoing, JPL shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, war, terrorism, riots, government actions including change in law, regulatory changes, power failures, internet or telecommunications failures, hardware or software failures, cyberattacks, or any act or omission of any third party (including Game Developers, Game Publishers, payment processors, or internet service providers).

JPL, including its Affiliates and their respective owners, directors, officers, agents, shareholders and partners, aggregate and total liability (whether in contract, tort, negligence, under an indemnity, or by statute or otherwise) shall not exceed INR 1,000/- (Rupees One Thousand) or the last payment made by the User, whichever is lesser, subject to applicable law and as awarded by a competent court.

Without limiting the foregoing, JPL shall not be liable for:

(a) any loss arising from the outcome of any Game;
(b) any loss of Virtual Items, in-game progress or data;
(c) any acts, omissions, conduct or content of any Game Developer or Game Publisher; or
(d) any interruption, delay, failure or unavailability of any Game or Service.

Discontinuance of Use

You may elect to discontinue using the Platform and the Services at any time by uninstalling the Application. If your Device is stolen or lost, you must immediately inform JPL to deactivate your account. You will remain responsible for any transactions made until your account is blocked by JPL. Discontinuance shall not relieve you of any accrued obligations or liabilities under these Terms, and all provisions that by their nature are intended to survive shall continue in full force and effect. The retention of your personal data following discontinuance shall be governed by the Privacy Policy.

No Waiver for Breaches

If we do not act or delay in action in relation to a breach of these Terms by you, that should not be construed as a waiver of any of our rights to act in relation to that breach or any later breach by you.

Redressal of Grievances

If you have any complaints or concerns with regards to content available through the Platform, to report any abuse of applicable laws, breach of these Terms, or any content or Game available through the Platform that is in violation of your rights, or the Services through the Platform are in violation of the IT Rules, the Online Gaming Act, or the Online Gaming Rules, then you may contact the Grievance Officer in the following manner:

Sending a request in writing or through email signed with electronic signature identifying the content alleged to be in infringement of your rights as the rightful owner or affecting you prejudicially;
Providing your contact information including email address, physical address, and telephone number where you can be contacted if required;
Giving a declaration cum undertaking along with necessary documents establishing you: (i) as the rightful owner of the content to be disabled / as a person affected prejudicially; (ii) stating that the information submitted is true, complete and accurate and no material fact has been hidden; and (iii) stating that JPL, its Affiliates, Directors, employees, including the Grievance Officer shall not be liable for any loss or damage or claim arising from reliance on such requests.

Grievance Redressal under the Online Gaming Rules

In addition to the above, where your grievance relates to matters governed by the Online Gaming Act and the Online Gaming Rules, you may invoke the grievance redressal mechanism prescribed under the Online Gaming Rules. Such grievances shall be acknowledged within the timeframes prescribed under the Online Gaming Rules and shall be resolved in accordance with the procedure set out therein. Where the grievance remains unresolved within the prescribed period, or where you are dissatisfied with the resolution provided, you may escalate the matter to the Authority.

The Grievance Officer shall address your complaint in accordance with the timelines prescribed under the IT Rules and the Online Gaming Rules, as applicable.

Governing Law and Jurisdiction

If a dispute arises regarding these Terms, the laws of the Republic of India shall apply, including the IT Act, the IT Rules, the Online Gaming Act, the Online Gaming Rules, and all other applicable legislation. Any dispute shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

Inconsistent Terms

If there is an inconsistency between these Terms and any other terms displayed on individual pages of the Platform ("Other Terms"), the Other Terms will govern to the extent of the inconsistency. JPL reserves the right to correct any ambiguities, omissions or errors in these Terms by amending or updating them and/or by issuing clarifications as may be necessary in due course.

Disclaimer

JioGames is a technology service provider operating as an intermediary. It is only facilitating and providing a technology platform for Users to access and interact with Games made available by independent third-party Game Developers or Game Publishers through the Platform. JioGames does not itself develop, publish or distribute the Games. The Games are published by the respective Game Developers or Game Publishers, and therefore Users are advised to review the terms and conditions of the relevant Game Developer or Game Publisher prior to accessing any Game. Users shall have recourse against the Game Developer or Game Publisher for any breach of conditions, representations or warranties, and JPL expressly disclaims any and all responsibility and liability in that regard. In no event shall JPL be liable for any information, content, materials, Games or Services available through the Platform.

To the maximum extent permitted by law, we disclaim all liability for any errors or omissions contained in this information or any failure to update or correct this information. The Services provided through the Platform are provided on an "as-is" and "with all faults and risks" basis and without warranties of any kind. To the maximum extent permitted under law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that use of the Services will be uninterrupted or error-free.

You understand that accessing the internet or using online gaming services may be harmful or cause losses, injury or damages to you and other persons, your equipment and other tangible and intangible properties. As a User of this Platform, you should make your own enquiries before entering into any transaction on the basis of or in reliance upon the content.

To the extent permitted by applicable law, we and our Affiliates, and their respective employees, officers, directors, agents, contractors, successors and assigns, exclude all liability for any loss or damage (including without limitation, indirect, special, incidental, consequential, punitive or exemplary loss or damage, loss of profits, loss of revenue, loss of data, loss of opportunity, or loss of goodwill) arising from the use of, or reliance upon, the Platform or any content thereon, whether or not this is caused by a negligent act or omission, and regardless of whether such loss or damage was foreseeable.

We expressly reserve the right, in our sole discretion, to suspend, change, modify, add or remove portions of the Platform and to restrict or terminate the use and accessibility of the Platform at any time without prior notice or liability. If any provision of these Terms (including this Disclaimer) is held to be invalid, illegal or unenforceable by any court or tribunal of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect any other provision of these Terms, and the remaining provisions shall continue in full force and effect. The invalid, illegal or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties to the maximum extent permissible under applicable law.

Any other product, service and company names mentioned herein may be trademarks, service marks or trade names of their respective owners. Your access to this Platform should not be construed as granting, by implication, estoppel or otherwise, any licence or right to use any marks appearing on the Platform without the prior written consent of the third-party owner thereof.
